1. Acceptance of Terms and Conditions

These Terms and Conditions govern your use of the Strawberry Handbags website (the "Site") and all Strawberry Handbags services and sales of products (the "Service"). By clicking on "Become a Member" to use the Service, you acknowledge and represent that you have read and understand these Terms and Conditions and that they become a binding agreement ("Agreement") between you and Strawberry Handbags, you agree to receive all communications from Strawberry Handbags under this Agreement electronically via email, you agree to keep your current email address updated under My Details on the Site at all times and you agree that you will be deemed to have received any notice we send to that email address. Whether or not you become a member, by visiting or browsing the Site, you accept these Terms and Conditions and any modifications made to them from time to time.

2. Becoming a Member and Obtaining an Account

Before you can begin use of the Service, you must register as a member through the Site and obtain an account ("Account").

You must be 18 years of age or older to register as a member and use the Service. Your membership will automatically renew for successive membership periods, unless you cancel your membership or your membership is otherwise terminated under these Terms and Conditions.

You are solely responsible for any activities related to your Account. If you suspect any unauthorized use of your Account, notify us immediately by using the “contact us” form on the Site or email customerservice@strawberryhandbags.com.au .

Upon account setup and password provision, valid Australian photo identification must be provided in a hard copy to successfully complete the registration. Acceptable forms of identification include a driver's licence, passport or any RTA approved identification. The copies of the identification should be faxed to (02) 9743 2741.

Commercial Affiliates and Corporate Accounts are required to nominate a principal contact person and provide their contact details for account setup. A credit application form is required to be completed and is available upon request.

3. The Strawberry Handbags Service

The Service allows registered members to access the Site and borrow or purchase products from Strawberry Handbags in accordance with these Terms and Conditions.

Members can choose products to borrow from Strawberry Handbags’ continually changing on-line selection, and have them shipped to the member's nominated address.

Members may borrow on a weekly or monthly basis. Additionally there is a “Rent to Buy” option available whereby members can enjoy a designer handbag today and pay it off over an agreed term. The “Rent to Buy” option is subject to approval and an application form is available upon request.

Members have the privilege of purchasing any bag listed on the Site. Please contact us by using the “contact us” form or email us at customerservice@strawberryhandbags.com.au and we will provide you with the current sale price for the item. Pricing will be based on the condition of the bag at the time.

Members have the privilege of obtaining exclusive access to sale events prior to public release. Members will be advised of these sales events by email to their registered email address.

Members are welcomed and encouraged to provide a “Wish List” of bags, not currently listed on the Site, which they may wish to borrow or purchase. We will source the bag you require and contact you as soon as possible.

We reserve the right to limit the number of items that a member may borrow and/or request the return of any or all borrowed items in your possession at any time.

4. Gift Coupons

We offer a range of gift coupons that can be applied toward any Strawberry Handbags services. In purchasing a gift coupon, you authorize us to charge your credit card for the nominated gift dollar amount. The recipient will receive their gift coupon electronically via email.

Recipients of the gift coupon are required to setup an account as a user themselves in order to make use of the gift coupon. Details will be provided to the recipient at the time of providing the gift coupon.

5. Billing

As a member, you will be required to provide Strawberry Handbags with valid credit card details prior to using any of the Services on the Site. The name on the credit card must be the same name as the registered name. A copy of both sides of the credit card is required prior to the first delivery. A hard copy is to be faxed to (02) 9743 2741.

If a new credit card is nominated, then the same procedure applies as above prior to shipping the item. Members’ personal information is securely protected at a location off-site of Strawberry Handbags and is solely used for the purposes of transacting the services provided by Strawberry Handbags. All credit card transactions are encrypted and passed directly to the Bank through our security provider.

When agreeing to the Service, you authorize Strawberry Handbags or its agent to bill your credit card the applicable charges you may incur in connection with your use of the Service.

You agree to notify Strawberry Handbags about any billing problems or discrepancies within 7 calendar days after they first appear on your Account statement. Please use the “contact us” form on the Site to advise us of any discrepancies. If you do not bring them to our attention within 7 calendar days, you agree that you waive your right to dispute such problems or discrepancies.

Paypal, Google Checkout or Direct Deposit are the preferred payment solutions.

For the first use of any Service, a deposit bond is required and will be proportionate to the value of the bag requested.

6. Shipping

The standard delivery time for products you have selected is 2 – 3 working days. Delivery time may vary based upon (a) inventory availability, (b) your delivery address, (c) when you place an order, and (d) other circumstances impacting delivery.

We will send you an email letting you know when your product has shipped.

7. Cancellations and Refunds

Order cancellations received prior to goods shipping will result in a credit to you membership account.

Order cancellations received after goods have been shipped are non-refundable.

You may cancel your membership at any time by contacting customer service by phone, email, or the “Contact Us” form. In some cases, you may be required to call customer service.

Upon receipt of your cancellation request, we will terminate your Account, provided that you have returned all outstanding products and paid for any unreturned or damaged products. You will be given 5 calendar days from the date you request your membership cancellation to return all outstanding borrowed products or satisfy any outstanding payments owed to Strawberry Handbags.

8. Privacy

Any information submitted on the Site is subject to our Privacy Policy, the terms of which are incorporated into these Terms and Conditions.

Members’ personal information is securely protected at a location off-site of Strawberry Handbags and is solely used for the purposes of transacting the services provided by Strawberry Handbags.

Members will receive monthly marketing emails, which can be unsubscribed, if preferred.

Associates who provide Strawberry Handbags shipping details of their clients are assured of complete privacy on behalf of their clients.

9. Member’s Obligations

By registering as a member through the Site, you agree to provide true, accurate, current and complete information about yourself as prompted by the Site's registration form (such information being the "Registration Data"), and you agree to maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have any reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your Account and refuse to offer you any and all current or future use of the Service and the Site. You are responsible for maintaining the confidentiality of your Account and password and for preventing unauthorised access to your account.

If Strawberry Handbags does not receive payment from your credit card provider or if your credit card expires or is rejected, you agree to pay all amounts due upon demand. Following any such non-payment, we may require you to provide a second valid credit card before continuing to use the Services and you authorize Strawberry Handbags to charge outstanding fees and other amounts due to us against any credit card you have on file with us.

Strawberry Handbags reserves the right to take all steps necessary to collect amounts due from you, including but not limited to legal action and/or using third party collection agencies. Strawberry Handbags reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

We reserve the right to determine whether your credit card(s) is/are pre-authorized to accept a minimum charge equal to your handbag and/or accessory rental or both. In the event we feel the amount of available credit is not sufficient to cover these amounts, we may request the immediate return of all outstanding items and/or that you provide a second valid credit card before continuing to use the Services.

You are solely responsible for any and all fees charged to your credit card by the issuer, bank, or financial institution including, but not limited to, membership, overdraft, insufficient funds, and over the credit limit fees.

If an item is returned in a damaged or dirty condition that exceeds normal wear and tear, as determined by Strawberry Handbags in its sole discretion, you agree that Strawberry Handbags may charge your credit card and collect a replacement fee for such product. The product replacement fee varies depending on the specifics of each bag.

10. Legal

In the case of a failure to pay any debts or to return any item(s) when due to Strawberry Handbags (hereinafter, a "default"), you will be liable to Strawberry Handbags for its actual damages, including but not limited to the then-current rental payment for each item until said item is received by Strawberry Handbags in an undamaged condition. If said item has not been returned in an undamaged condition before the expiration of 30 days after the date of default, then Strawberry Handbags at its option may alternatively charge you the RRP as maintained by Strawberry Handbags for that item, plus 7 days rent from the date of default, or seek to recover the wrongfully-retained item plus all rent owed to the date of recovery of the undamaged item.

If Strawberry Handbags commences action to recover its property from you, to recover actual damages, and/or to recover liquidated damages, you agree that the substantially prevailing party will be entitled to recover its reasonable solicitors' fees and expenses of litigation. You further agree that Strawberry Handbags will be entitled to recover prejudgment interest on its actual damages and its liquidated damages from the date of default to the date of judgment entry at the rate of 22% per annum.

Strawberry Handbags expressly reserves its right to seek additional elements of actual damages other than those expressly identified above.

11. Modifications to Terms and Conditions

Strawberry Handbags ("we," "us," and "our") reserves the right, upon notice to you via email to change or terminate this Agreement. You agree that your use of the Service after notice of change to these Terms and Conditions means that you accept the changes; you also agree that, if you do not return outstanding items and close your Strawberry Handbags account within seven (7) calendar days of such notice, you accept the changes. Please check the “terms and conditions” section of the Site before using the Site to determine whether a change has been made to these Terms and Conditions.
